Business Crimes & Investigations: Misuse of Trust Funds

After conducting investigations into the misuse of trust funds holding public money, we advised the Organisation Undoing Tax abuse (OUTA) to apply to the high court for a freezing order relating to the funds contained in 2 mine rehabilitation trusts which formed part of the infamous Gupta state capture. Outa was successful in obtaining a freezing order. Notwithstanding the ineptitude of the Asset Forfeiture Unit, whose actions threatened to imperil these funds, OUTA was successful in convincing the court that these funds should still be frozen. Now that a new minister of minerals and energy has been appointed, Outa promoted that these funds be transferred to an account under the control of the Minister in terms of prevailing legislation which will serve to safe guard these funds for their ultimate purpose of rehabilitation.
