Arbitration is a popular and widely used method of commercial dispute resolution in South Africa and worldwide.
Globally, commercial dispute resolution most commonly takes place through the method of arbitration. Since the enactment of the new International Arbitration Act in 2016, there has been a modernisation of South African arbitration law; which is stimulating the development of South Africa as a major regional arbitration centre.

Our arbitration lawyers have unmatched depth of experience and expertise in their field. Highly specialised directors with extensive experience mentor and guide younger up-and-coming lawyers, their combined perspectives helping forge a formidable arbitration team known for its high success rate. Pulling all this experience together is the head of our Arbitration practice and current Chairman of the International Chamber of Commerce South Africa (ICCSA), Des Williams.

An extensive international arbitration network

Arbitration lawyers benefit from exposure to international practice, which is why through our team’s international networks – particularly the International Bar Association (IBA) and the International Court of Arbitration of the International Chamber of Commerce (ICC) – we have developed an extensive international arbitration network. Locally, we are a founder member of the Arbitration Foundation of Southern Africa (AFSA), the leading South African arbitration organisation, and will continue to play an important role in the development of South Africa as a regional arbitration centre.

Werksmans is one of the signatories to the Johannesburg Consensus of the China Africa International Arbitration Centre (CAIAC), operating as an arbitration centre in South Africa and China.

Our arbitration lawyers offer the full range of services, both in local and international arbitrations. Senior members of the team are able to arbitrate when appointed by an arbitration organisation or through agreement between the parties. We also provide comprehensive services in other forms of alternative dispute resolution, including mediation, where senior members of the team are able to assist in the mediation of commercial disputes.
