ABOUT

Nkonzo Hlatshwayo has considerable experience in competition law spanning almost 25 years and focuses on general competition work. With deep regulatory experience, having worked at senior levels of the South African Competition Commission, combined with equally deep experience in large competition law practices for almost 20 years, Nkonzo is eminently qualified to and advises parties in merger proceedings, complaint proceedings, intervention applications, leniency applications, as well as cross-border merger transactions and investigations. He has appeared before a number of African jurisdictions including regional competition authorities such as the COMESA Competition Commission. Nkonzo also advises on competition law compliance and audits, providing strategic insights to clients on how to embrace risk without crossing the line. More recently, he has assisted large South African and international firms to deal with complex abuse of dominance complaints.

Advised / Represented / Acted on behalf of: 

  • Advising Transnet in relation to abuse of dominance allegations involving excessive pricing, price discrimination and other allegations by the Competition Commission
  • Representing Nedbank in respect of the forex proceedings involving national and international banks
  • Representing Access Bank in relation to the Competition Commission’s investigation of several banks accused of cartel conduct and abuse of dominance 
  • Advised Thebe Investment Corporation and notified several transactions in multiple sectors, one of which involved the PIC
  •  Advised and notified a transaction for Old Mutual in respect of its acquisition of an several insurance businesses in other parts of Africa
  • Advised African Rainbow Capital in respect of an acquisition which required notification to the competition authorities
  • Advised firms in the financial services sector in respect of pre-merger transition planning prior to competition approval
