Jacqui Kallmeyer is a Director in the Arbitration and Dispute Resolution practice areas. Her areas of specialty include commercial  litigation and dispute resolution; arbitration and alternative dispute resolution; general litigation; insurance litigation; corporate fraud; and mining and resources. Jacqui was one of the lead attorneys representing the Steinhoff Group in resisting claims instituted against it pursuant to one of the largest corporate collapses in South African history, and in pursuing claims against various third parties.

Jacqui holds an LLB and a BA (Law and Psychology) from the University of Witwatersrand.

Advised / Represented / Acted on behalf of:

  • Lead attorney in confidential arbitration proceedings, representing the liquidators of an insolvent estate for damages in excess of ZAR 150 million arising from alleged breaches of warranties pursuant to the conclusion of a Sale of Business Agreement entered into between the parties.
  • Lead attorney in confidential arbitration proceedings, representing a major financial institution and others in defending proceedings launched by a JSE-listed company for claims in excess of ZAR 300 million arising from alleged breaches of warranties pursuant to the conclusion of a Sale of Business Agreement entered into between the parties.
  • Lead attorney in representing one of the major South African cellular networks in defending proceedings launched  against its Liberian subsidiary.
  • Lead attorney in representing one of the major South African banking institutions in defending various litigation in Nigeria.
  • Represented the Steinhoff Group of Companies in resisting claims instituted against it pursuant to one of the largest corporate collapses in South African history, and in pursuing claims against various third parties as a result thereof, including, amongst others, the following:
    • Lead attorney representing the Steinhoff Group in proceedings against Markus Jooste and Andries Benjamin La Grange seeking the recovery of remuneration paid to Messers Jooste and La Grange pursuant to the accounting irregularities discovered within the Steinhoff Group. The claims in this regard aggregate to in excess of ZAR 600 million and € 16 million;
    • Lead attorney representing the Steinhoff Group in proceedings against Stephanus Johannes Grobler seeking the recovery of remuneration paid to him pursuant to the accounting irregularities discovered within the Steinhoff Group. The claims in this regard aggregate to almost ZAR 240 million and approximately € 1,7 million;
    • Lead attorney representing Steinhoff Group entities in arbitration proceedings against Mayfair Speculators Proprietary Limited in relation to claims arising out of payments made by Steinhoff entities to Mayfair in circumstances where it was asserted that payments made were not due, owing or payable, which claims aggregated to approximately ZAR260million and approximately € 31 million;
    • Key member of the team who represented the Steinhoff Group in a class action certification application brough by Ms Dorethea De Bruyn, which class action certification application was brought against 42 respondents. The application for certification was dismissed by the Judge in a landmark decision for its day;
    • Key member of the team representing Steinhoff in proceedings brought against it by Lancaster 101 (RF) Proprietary Limited, pursuant to agreements concluded for the acquisition of shares in Steinhoff International Holdings NV to the value of over ZAR 11 billion; 
    • Key member of the team representing the Steinhoff Group in defending claims for damages in excess of ZAR 13 billion brought by the PIC and Government Employees Pension Fund;
    • Key member of the team representing the Steinhoff Group in claims brought against it by various entities (referred to as the Tekkie Town entities) in a dispute arising pursuant to a sale of shares and claims agreement, being claims in excess of ZAR1,8 billion;
    • Key member of the team representing Steinhoff International Holdings NV in an application brought for the winding-up of that entity;
    • Key member of the team representing the Steinhoff Group in claims against it based on certain so-called "share swop" agreements brought by –
      • GT Ferreira and his trusts, in claims to the total value of approximately ZAR 1,17 billion;
      • the Le Toit Trust in claims aggregating to ZAR 740 million;
      • various other individuals in claims aggregating to approximately ZAR 450 million;
    • Key member of the team representing the Steinhoff Group in various actions for damages brought against it by –
      • Trevo Capital Limited in an amount in excess of ZAR 2,1 billion;
      • Hamilton BV and Hamilton BV2 in claims in excess of ZAR 14 billion;
      • various other individuals and entities aggregating to in excess of ZAR 500 billion;
    • Part of the team who succeeded in obtaining a successful approval and sanction of the Section 155 proposal by Steinhoff International Holdings Proprietary Limited pursuant to which the so-called "Steinhoff Global Settlement" was ultimately reached;
    • Key member of the team representing the Steinhoff parties in liaising with attorneys in the UK, Netherlands and Germany in relation to the issues arising up to and pursuant to the "Global Settlement" and in relation to the litigation instituted by or against the Steinhoff parties in those jurisdictions.
