ABOUT

Athi Jara is a Director in the Land Reform, Mining & Resources and Environmental practice areas at Werksmans. She was part of the team of experts that advised the Department of Energy and National Treasury on how to roll out and implement South Africa’s Renewable Energy Independent Power Producers Programme. She concentrates on mining, environmental and climate change, occupational health and safety, energy and public procurement law. In 2019, she was featured as one of the Mail and Guardian’s 200 young thinkers to watch. Athi did her articles at Eversheds (Routledge Modise Inc.) from 2009 to 2011. In 2011, she moved to Bowman Gilfillan as an associate. From 2014 to 2017, she was a senior associate at Edward Nathan Sonnenberg Inc. She then moved to LNP Attorneys Inc., where she was a Director and head of Mining and Environmental Law Department.

  • Conducting a due diligence on behalf of Globe Specialty Metals Inc. (NASDAQ: GSM) in a transaction that saw the merging of two of the largest steel companies in the world. This was a merger of equals where the one company was based in the United States of America and the other company was based in Spain, with South African subsidiaries.
  • Advised Standard Bank in relation to its investment into a mining company listed on the Johannesburg Stock Exchange (“JSE”) and Australian Stock Exchange (“ASX”) with regards to a coal mine being established in the Limpopo Province.
  • Advised Village Main Reef on whether it may transfer its rehabilitation liabilities in line with the provisions of the Mineral and Petroleum Resources Development Act, 2002.
  • Advised Butsanani Energy Investment Holding, a joint venture between Anglo American Zimele (Proprietary) Limited and Vunani Mining (Proprietary) Limited in its acquisition of certain coal assets from Exxaro Resources Limited (“Exxaro”). She also conducted a due diligence exercise on coal assets at Exxaro’s Inyanda Mine.
  • Advised the Joint Provisional Liquidators on a number of matters in connection with the liquidation of the Blyvooruitzicht Gold Mining Company Limited (“Blyvoor”), a company in provisional liquidation, and the disposal of Blyvoor Mine and mine assets.
  • Advised Keaton Energy Holdings Limited in respect of the establishment of the Vanggatfontein Colliery and drafted Mining Contractorships required for the development and operation of the Keaton Energy Mine situated near Delmas, Mpumalanga Province.
  • Advised AngloGold Ashanti in respect of the environmental implications of the proposed expansion project involving the Kopanang and Noligwa Mines, which are part of the Vaal River Operations.
